These Terms of Use specify the terms under which you may access and use 2FIRSTS’s website located at https://2firsts.com, 2FIRSTS’s digital news, 2FIRSTS’s mobile application (the “App”), other 2FIRSTS digital properties, and related services (collectively, the “Services”). By using the 2FIRSTS.COM sites, you expressly accept and agree to be bound and abide by these Terms of Use, and our Terms of Sale and Privacy Policy, incorporated herein by reference. If you do not agree to be bound by these Terms of Use, you may not access or use 2FIRSTS.COM. Audience and Minimum Age Requirements All platforms operating under the 2FIRSTS are directed toward and solely intended for businesses, organizations and their employees and are not intended for a general or consumer audience. We do not intentionally collect or maintain information from individuals known to us to be under the age of legal purchase for tobacco and nicotine products in the jurisdiction in which individuals access our systems or attend our events. It is the policy of the 2FIRSTS to not engage with anyone under the age of 18 or under the age of purchase for tobacco and vape products in their jurisdiction of domicile, if different from 18. When registering for an event accessed via the internet, you are expressly agreeing to enter into a license to view that event as if you and the event are in China. The age of purchase in China is 18, and under Chinese law, anyone under age 18 is a minor. We may request certification or verification of your age. This information is retained only insomuch as is necessary for verification of age and compliance with legal requirements. The 2FIRSTS also collects email addresses for the purpose of registering attendees for events. The 2FIRSTS may share your email address with third parties for the purposes of event management and post-event audience analysis or upon receipt of lawful legal process. In the event the 2FIRSTS collects such information and then determines that the registrant providing this information is a minor, the collected information will be permanently deleted from our records, and we will instruct any third-party provider to do likewise. Intellectual Property The Services contains material, such as photographs, software, text, graphics, images, and other material provided by or on behalf of 2FIRSTS (collectively referred to as the “Content”). The Content may be owned by us or third parties. The Content provided through the Services is protected under both Chinese and foreign laws, including, but not limited to, copyright and trademark laws, and unauthorized use of the Content may violate such laws. You may view all Content for your own personal, non-commercial use, and no other use is permitted without the prior written consent of 2FIRSTS. 2FIRSTS and its licensors retain all right, title, and interest, including all intellectual property rights, in and to the Content. You must retain all copyright and other proprietary notices contained in the original Content. You may not sell, transfer, assign, license, sublicense, or modify the Content or reproduce, display, distribute, or otherwise use the Content in any way for any commercial purpose. We reserve the right to remove Content from our Services at any time for any reason without any notice to you. If you violate any part of this Agreement, your permission to access the Content and the Services automatically terminates and you must immediately destroy any copies you have made of the Content. The trademarks, service marks, and logos of 2FIRSTS used and displayed on the Services are registered and unregistered trademarks or service marks of 2FIRSTS. Without limiting the generality of the foregoing, 2FIRSTS does not warrant that: (1) the information on the services is correct, accurate or reliable; (2) the functions contained on the services will be uninterrupted or error-free; or (3) defects will be corrected, or that the services or the server that make them available is a secure connection. In connection with any warranty, contract, or common law tort claims: (i) we and our licensors shall not be liable for any incidental or consequential damages, lost profits, or damages resulting from lost data or business interruption resulting from the use or inability to access and use the services or the content, even if we have been advised of the possibility of such damages; and (ii) any direct damages that you may suffer as a result of your use of the services or the content shall be limited one hundred US dollars ($100). Prohibited Uses of 2FIRSTS.COM You may use services and content from 2FIRSTS only for lawful purposes and in accordance with these Terms of Use. Additionally, you agree not to interfere with or attempt to interfere with the proper working of 2FIRSTS, including but not limited to: 1) Use 2FIRSTS in a manner that could disable, overburden, damage, or impair 2FIRSTS Services or interfere with any other party’s use of Services; 2) Use any device, software or routine that interferes with the proper working of 2FIRSTS Services; introducing any viruses, Trojan horses, worms, logic bombs or other material which is malicious or technologically harmful; 3) Attempt to gain unauthorized access to, interfere with, damage or disrupt any part of 2FIRSTS Services, the server on which 2FIRSTS Services are stored, or any server, computer, or database connected to 2FIRSTS; or 4) Attack 2FIRSTS.COM via a denial-of-service attack or distributed denial-of-service attack. We retain the right to pursue civil, criminal, and/or administrative penalties, fines, or sanctions against the user and those assisting the user engaging in a prohibited use of 2FIRSTS Services.
